GRG operated as a profit centre, not a recovery unit. FCA Skilled Persons Report (2018) confirmed 9 in 10 businesses experienced some form of mistreatment. "Dash for cash" protocol: review fees £400/month, risk fees up to £150,000/year, security fees £7,000 charged to distressed businesses. West Register (RBS property arm) bought client assets cheaply after GRG manufactured distress — a direct conflict of interest. In 2026, GRG manager Stuart Holloway was convicted of accepting £600,000 in bribes from distressed clients (Bribery Act 2010).

Six perpetrators jailed for the HBOS Reading fraud — businesses were forced to use Quayside Corporate Services (fake turnaround consultants), then stripped of assets through extortion and corruption. Lloyds initially operated an inadequate internal compensation scheme; the Foskett Review (2020) found serious shortcomings, forcing an independent panel. Separately, historical IRHP mis-selling to SMEs forced businesses into administration, subject to the FCA industry-wide redress scheme covering approx. 29,500 cases.

FCA (2024): HSBC failed 1.5 million customers in financial difficulty between 2017–2018 through deficient policies and staff training. Separately: HK$400m SFC fine for structured product mis-selling (2017), $1.9bn AML penalty (2012), and PPI/swap mis-selling included in the $4.2bn global settlement.

Barclays was the first bank fined for LIBOR rate manipulation — £290m in 2012 for submitting false rates to benefit trading positions, directly affecting borrowers with LIBOR-linked loans and mortgages. Barclays Partner Finance (BPF) operated within the discretionary commission arrangement (DCA) model for vehicle finance during the 2007–2021 period now under Supreme Court scrutiny. PPI mis-selling provisions exceed £11bn.

The Institutional Failure

Black Horse Finance operated the discretionary commission arrangement model across millions of vehicle finance agreements between 2007–2021. Under DCA, the dealer could set a higher interest rate and earn more commission — a direct conflict of interest never disclosed to consumers. The Supreme Court's 2024 ruling confirmed this arrangement was unlawful. Black Horse's volume means it represents the single largest pool of affected agreements in the UK.

The Institutional Failure

Northern Rock's Together mortgage product offered 100-125% LTV without adequate income verification or affordability assessment. Post-nationalisation, the mortgage book was transferred to NRAM (now Landmark Mortgages / Topaz Finance), which continues to charge standard variable rates (currently 7.74%) that former borrowers cannot remortgage away from due to tightened lending criteria — trapping them as "mortgage prisoners." The ongoing rate application constitutes a continuing breach.

Close Brothers was the named defendant in the Court of Appeal ruling that triggered the Supreme Court PCP review. Both are primary targets in the vehicle finance commission claims landscape.

Close Brothers Motor Finance is the lead case defendant — its name is on the Court of Appeal judgment that escalated to the Supreme Court. Santander Consumer Finance operated an extensive DCA model across major UK dealership networks throughout the 2007-2021 window. Both entities used broker commission structures where the dealer set the interest rate (and therefore their commission) without disclosure. The Supreme Court confirmed this breached the law.
